I think that if a developer fails to provide support or respond then he has abandoned the work and why should the license holder expect any future support therefore the license holder has every right to do whatever they want ethically. Developers who abandon license holders and fail to provide support without notice are the most unethical people on the planet and the cause of huge expenses to the victims of the developer's failed business model.
